<p>Florida’s nurse practitioners and physician assistants were hopeful the Senate would vote to allow them to have the authority to order the involuntary commitment of a patient for mental-health evaluation under the Baker Act. However, instead on April 15, 2013, the Children, Families and Elder Affairs Committee passed the formation of a work group to figure out how to improve the more than 40-year-old Florida mental health act.</p>
<p><strong>Nurse Practitioners and Physician Assistants Want to Broaden Their Powers.</strong></p>
<p>Currently, nurse practitioners and physician assistants can perform an evaluation, but cannot sign off on voluntary or involuntary examination paperwork to admit someone to treatment under the Baker Act. Instead, they must wait for a physician or law enforcement official to perform another evaluation and sign the paperwork. As this process is going on, the patient is free to go, meaning that person may leave the health facility before receiving the care they need.</p>
<p><strong>Work Group Will Measure the Efficiency and Effectiveness of Baker Act.</strong></p>
<p>The work group established by the senate must determine the necessary revisions that need to be made to improve the Baker Act. The group must file a report on their findings by January 14, 2014.</p>
<p>In a Tampa Bay Times article, senators voiced their concerns about the Baker Act, but said they wanted to know exactly what happens after a person is committed and the type of treatment patients receive. In the same Tampa Bay Times article, members of the Florida Association for Nurse Practitioners said the state’s 1,300 nurse practitioners are hoping for a decision this year. <p>Often we learn after the fact that a health professional such as nurses, advance registered nurse practitioners (ARNPs), certified registered nurse practitioners (CRNPs) and nurse midwives (NMs) has received Nurses Service Organization (NSO) insurance, has had a legal problem, and has not been able to locate an attorney or law firm that accepts this type of insurance. <p><strong>The Duty of Reasonable Care.</strong></p>
<p>The plaintiff must first show that the nurse had a duty to provide care for the plaintiff. The element of duty is usually straightforward and relatively easy for the plaintiff to prove because once nurses undertake care for their patients they have a clear duty to provide care for that patient in a competent and reasonable manner. Nurses owe a clear duty of care to all of their patients.</p>
<p><strong>Breach of Duty.</strong></p>
<p>When applied to nursing, a breach of a duty occurs when a nurse does, or does not do, what a reasonable nurse would have done under the same, or similar, circumstances. This would mean that the nurse’s care fell below the acceptable standard of care.<br />
The standard of care is a legal concept which reflects how a nurse is expected to act professionally. It incorporates the expectation that nurses conduct themselves with the degree of care, skill and knowledge that reasonably competent nurses would exhibit in a similar situation. It is important to remember that the standard represents a minimum level of practice to which nurses must adhere in order to avoid being found negligent. In other words, nurses do not have to exert heroic efforts to perform their job satisfactorily; they are expected to exercise their good judgment, education and training to the best of their ability, under the circumstances. Nursing care that falls below the acceptable standard of care may result in a medical malpractice lawsuit against the nurse. The standard of care is particular to each field of nursing practice. For instance, orthopedic nurses determine the standard of care for orthopedic nurses.</p>
<p><strong>Injury or Damage.</strong></p>
<p>To prove the element of injury the plaintiff must be able to establish that, in addition to pain and suffering, they have experienced a physical injury, lost money or have an actual reduction in the quality of their life. The injury which the plaintiff suffered will help to determine the monetary damages that will be awarded if the plaintiff succeeds at trial.</p>
<p><strong>Causation.</strong></p>
<p>Causation is often the most difficult element of medical malpractice to prove. In order to prove that the defendant caused their injury, loss or harm, the plaintiff must show that the defendant&#8217;s act or omission either caused, or was a substantial factor in causing, harm to the plaintiff. If the defendant proves that the harm would have occurred anyway, irrespective of the defendant’s act or omission, then the negligence action will fail for lack of causation.</p>
<p><strong>Sources for the Standard of Care.</strong></p>
<p>Where do nursing standards come from, and who decides what the standard of nursing care should be in each particular medical malpractice case? The answer is that the sources for nursing practice standards are varied. The court relies on some or all of theses sources to help determine the applicable standard of care in each individual case.<br />
Some of these sources for nursing standards include:</p>
<p style="padding-left:30px;">1. Florida Nurse Practice Act, Chapter 464, Florida Statutes;<br />
2. Other Florida Statutes and the Florida Administrative Code;<br />
3. Case law;<br />
4. Principles, guidelines and standards of professional associations such as the American Nursing Association (ANA);<br />
5. The Joint Commission on Accreditation of Healthcare Organizations (JCAHO);<br />
6. Hospital Policies;<br />
7. Standards of Care as testified to by other members of the profession; and<br />
8. Authoritative Nursing Texts and Journals.</p>
<p><strong><br />
Nurse’s Accountability for the Standard of Care.</strong></p>
<p>As a licensed nurse, you are expected to know what the generally accepted standard of care entails and follow that general standard in your daily practice. The policy and procedure manual of your facility should contain nursing care guidelines. However, if the facility you are working in does not adhere or comply with the generally accepted standard of nursing care, then, following the facility’s policies and procedures will not protect you from a charge of malpractice. This is because all nurses are accountable for the nurse’s standard of care. If you are aware that your facility’s policies and procedures are below the generally accepted standard of care, then you should promptly notify your nurse-manager or the risk-control committee of your concerns.</p>
<p><strong>Conclusion.</strong></p>
<p>Over the years nurses are becoming ever more likely targets for plaintiffs, and their attorneys, in medical malpractice cases. It is extremely important for a nurse to know the malpractice laws that encompass the nursing profession. By knowing each element of medical malpractice and the different standards of care that a nurse is held to. A nurse who can adhere to the different standards of care can avoid being held liable for medical malpractice.</p>

<p>A wrongful act that causes harm to a person for which the law allows a person to recover is called a &#8220;tort.&#8221; The most common type of tort is one based on negligence. In order to recover form a tort based on negligence, there are four elements which must be met are that there is an act (or failure to act) in which the following are present: 1) a duty owed by the one performing the act to the one who is harmed; 2) an act (or failure to act) which breaches that duty; 3) actual damage or harm sustained; and causation (in other words, the act or failure to act caused the damage or harm).</p>
<p>Malpractice is just another name for professional negligence. Professional negligence is a tort committed by a licensed professional, in this case a nurse. In order to show nursing malpractice, one must show all of the elements of a negligence tort. The only difference is that in professional negligence, the duty that must be shown is the professional duty that the licensed professional owes to the one injured, in this case, her patient. Accordingly, the duty owed will be one of the nurses professional duties as a nurse.</p>
<p>I will discuss the concept of nursing malpractice further in this two-part blog series.</p>
<p><strong>Defining Negligence.</strong></p>
<p>Negligence is the failure to use such care as a reasonably prudent person would use under similar circumstances.</p>
<p>The law of negligence is part of what is known as &#8220;tort&#8221; law. The term &#8220;tort&#8221; originates from the French word meaning &#8220;wrong.&#8221; The law of negligence therefore deals with injuries or a wrong caused by one person towards another. Most negligence lawsuits are civil, not criminal, cases. A person can be found negligent even though they did not actually intend to harm the inured party, because negligent conduct is the behavior which results in unintended harm.</p>
<p><strong>Defining Medical Malpractice.</strong></p>
<p>Medical malpractice can occur when a health care professional fails to exercise the degree of care that a reasonable health care professional would exercise under the same or similar circumstances. In other words, medical malpractice is negligence committed by a health care professional.</p>
<p>Medical malpractice is a specialized area of law that deals with negligence claims against health care professionals. Medical malpractice is often perceived as conduct which is somehow more egregious than mere negligence. This perception is erroneous because medical malpractice is simply ordinary negligence by a healthcare provider that causes some injury to the patient.</p>
<p>Several years ago nurses were only liable for negligence. Although as nurses exercise more autonomy, their legal liability has changed. Courts in a number of states recognize and identify nursing negligence as a form of medical malpractice.</p>
<p>A Florida lawsuit helps to illustrate this point. In this case, a mother made a routine prenatal visit to the hospital. While in the waiting room the mother complained to the nurse of severe abdominal pain. Over the next hour and a half the mother complained of pain five times, each time she was told that she would have to wait to be examined. When the mother was finally examined her unborn child&#8217;s fetal heart rate was only 60 to 70 beats per minute. An emergency cesarean section was performed but the baby was born severely depressed, hypoxic, suffered from severe brain injury and developed seizures within the first hour.</p>
<p>In this case the nurse did not intend to cause harm to the baby or the mother, however the nurses failure to have the patient examined when she complained of severe abdominal pain and her failure to recognize the onset of fetal distress was negligent. A reasonably prudent nurse would have had the patient examined by a physician and recognized signs of fetal distress when the patient complained of acute abdominal pain. The hospital settled this case for $2 million.</p>
<p><strong>The Four Elements of Medical Malpractice.</strong></p>
<p>In order to prevail in a medical malpractice lawsuit, the plaintiff must prove each of these four elements:</p>
<p style="padding-left:30px;">1. the defendant owed the plaintiff a duty of reasonable care;<br />
2. the defendant breached her duty;<br />
3. the plaintiff incurred an injury, loss or harm; and<br />
4. the defendant’s acts or omissions caused the plaintiff’s injury, loss or harm.</p>
<p>The plaintiff must prove each of these four elements by a preponderance of the evidence. A preponderance of the evidence means that it is more likely that the defendant committed the medical malpractice than not.</p>

<p>A. A case involving an arrest or a conviction involving alcohol abuse (DUI/public Intoxication) or drugs (possession, diversion, theft, trafficking) will probably result in an emergency suspension order (ESO) until the entire licensure case is complete.</p>
<p>B. Client may be required to be evaluated and probably enrolled in the Impaired Nurses Program (IPN) (for nurses only) or the Professionals Resource Network (PRN) (for all other licensed health professionals), which is usually at least a five year contract.</p>
<p>C. Action to revoke, suspend or take other action against the clinical privileges and medical staff membership of those licensed health professionals who may have such in a hospital, ambulatory surgical center, skilled nursing facility, or staff model HMO or clinic. This will usually be advance registered nurse practitioners (ARNPs) and certified registered nurse anesthetists.</p>
<p>D. Mandatory report to the National Practitioner Data Base (NPDB) (Note: Healthcare Integrity and Protection Data Bank or HIPDB recently folded into NPDB) which remains there for 50 years.</p>
<p>E. Must be reported to and included in the Department of Health (DOH) profile that is available to the public online (for those having one), and remains for at least 10 years.</p>
<p>F. Any other states or jurisdictions in which the client has a license will also initiate action against him or her in that jurisdiction. (Note: I have had two clients who had licenses in seven other states).</p>
<p>G. The Office of Inspector General (OIG) of Department of Health and Human Services (HHS) will take action to exclude the provider from the Medicare Program. If this occurs (and most of these offenses require mandatory exclusion) the provider will be placed on the List of Excluded Individuals and Entities (LEIE) maintained by the HHS OIG.</p>
<p>H. If the above occurs, the provider is also automatically &#8220;debarred&#8221; or prohibited from participating in any capacity in any federal contracting and is placed on the U.S. General Services Administration&#8217;s (GSA&#8217;s) debarment list.</p>
<p>I. The U.S. Drug Enforcement Administration (DEA) will act to revoke the professional&#8217;s DEA registration if he or she has one.</p>
<p>J. The certified health professional&#8217;s certify organization will act to revoke his or her certification.</p>
<p>K. Third party payors (health insurance companies, HMOs, etc.) will terminate the professional&#8217;s contract or panel membership with that organization.</p>
<p>L. Any profile maintained by a national organization or federation (e.g., American Medical Association physician profile or Federation of State Boards of Physical Therapy profile) will include the conviction.</p>
<p>M. Regardless of any of the above, any facility licensed by AHCA (hospitals, skilled nursing facilities (SNFs), public health clinics, public health clinics, group homes for the developmentally disabled, etc.) that are required to perform background screenings on their employees will result in AHCA notifying the facility and the professional that he or she is disqualified from employment.<br />

<p><span style="font-size:10pt;">The warnings have been loud and clear from the Centers for Disease Control and Prevention (CDC). This influenza season is off to an early and serious start. With that in mind, a number of states are requiring all health professionals in the state to receive the flu vaccination. Some of those opposed to getting vaccinated are being fired by hospitals and health facilities. Because of this, a controversy is arising between employee rights and patient safety, according to a number of news sources.</span></p>
<p><span style="font-size:10pt;"><span style="font-size:10pt;"><a href="http://www.cdc.gov/flu/about/season/" target="_blank">Click here to read more on this year’s flu season from the CDC</a>.</span></span></p>
<p><span style="font-size:10pt;"><strong>Agenda Calls for a 90% Average Vaccination Rate of Health Professionals by 2020.</strong></span></p>
<p><span style="font-size:10pt;">In December 2010, the Department of Health and Human Services (DHHS) announced a 10-year agenda to improve the nation’s health. It’s called Healthy People 2020. A part of this agenda calls for a ninety percent (90%) average vaccination rate of health professionals. <a href="http://www.healthypeople.gov/2020/about/DefaultPressRelease.pdf" target="_blank">Click here to read the press release on the Healthy People 2020 initiative from the DHHS</a>.</span></p>
<p><span style="font-size:10pt;">According to an American Medical News article, there’s a push in the medical community to meet this goal as soon as possible. The CDC states that as of November 18, 2011, close to eighty-four percent (84%) of doctors in the U.S. had been immunized against influenza. The CDC is praising these doctors for this high number, hoping other health professionals and the public will follow suit.</span></p>
<p><span style="font-size:10pt;">The safety of patients is the chief reason for the mandate. In an ABC News article, one Indiana hospital said that it implemented the mandatory vaccine in September of 2012, to promote patient safety. Of the hospital’s 26,000 employees statewide, ninety-five percent (95%) have complied.</span></p>
<p><span style="font-size:10pt;"><strong>Two Indiana Nurses and Others Fired for Not Getting Vaccinated.</strong></span></p>
<p><span style="font-size:10pt;">A large majority of employees at the Indiana hospital complied with the mandate; however, 1,300 employees did not. According to ABC News, eight employees, including at least three veteran nurses, were allegedly fired because they refused to get a flu vaccine.</span></p>
<p><span style="font-size:10pt;">The fired nurses are standing their ground, saying they should have the right to refuse the flu vaccine. One nurse had filed two medical exemption requests, a religious exemption request and two appeals. All were denied by the hospital. <a href="http://abcnews.go.com/Health/indiana-hospital-fires-nurses-refusing-flu-shot/story?id=18116967" target="_blank">To read more on this story from ABC News, click here</a>.</span></p>
<p><span style="font-size:10pt;">In October 2012, Rhode Island mandated immunizations for all health care workers who have patient contact. On December 6, 2012, a health care worker union filed a federal lawsuit against the Rhode Island Department of Health (DOH) to prevent it from implementing the regulations, according to a Fierce Healthcare article. <a href="http://www.fiercehealthcare.com/story/health-unions-sue-over-mandated-flu-shots/2012-12-10" target="_blank">Click here to read the entire Fierce Healthcare article</a>.</span></p>
<p><span style="font-size:10pt;"><strong>Fighting the Mandate.</strong></span></p>
<p><span style="font-size:10pt;">The attorney representing the Indiana nurses, who were fired, states that his clients had the right to refuse their flu shots. He argues Title VII of the Civil Rights Act of 1964 prohibits religious discrimination against employees. The attorney is suggesting religion is legally broad under the First Amendment, so it can include any strongly held belief. According to a Chicago Tribune article, in 2009 New York mandated flu shots for all health workers, during the H1N1 outbreak. Unions fought the issue in court, and the state has since relaxed the rule.</span></p>
<p><span style="font-size:10pt;"><strong>Florida Health Care Professionals Worried About Jobs.</strong></span></p>
<p><span style="font-size:10pt;">I’ve recently received calls from several local health care professionals working in different Florida hospitals, regarding refusing flu shots and other vaccinations. I’ve also read the news stories about Tampa General Hospital and Moffitt Cancer Center in Tampa requiring employees to receive the influenza vaccine. According to the news articles, the two Tampa health facilities require employees who refuse the flu shot to wear surgical masks.</span></p>
<p><span style="font-size:10pt;">However, the states and hospitals may not back down in this case. The issue may have to be decided by the courts. I promise to write more on this topic later.</span></p>

<p><span style="font-size:10pt;">We are sometimes told by the health professionals we represent especially pharmacists, licensed mental health counselors (LMHCs), advanced registered nurse practitioners (ARNPs), massage therapists and physical therapists that after they received a complaint regarding their license from the Florida Department of Health (DOH) they had difficulty finding an experienced attorney in Florida who would accept their professional liability insurance.  In this case, I am speaking specifically about Healthcare Providers Service Organization (HPSO) Insurance.</span></p>
<p><strong style="color:inherit;font-size:10pt;line-height:1.7;">Benefits of HPSO Insurance.</strong></p>
<p><span style="font-size:10pt;">The professionals who are covered by HPSO Insurance have excellent insurance coverage.  HPSO Insurance provides </span><span style="font-size:10pt;">professional liability coverage that protects in the event of a lawsuit or negligence claim.  But much more often the professional receives a notice of an investigation, a subpoena for a deposition in someone else&#8217;s case, a demand because of an allegation of sexual harassment or sexual impropriety, a complaint because of a breach of medical records confidentiality or Health Insurance Portability and Accountability Act (HIPAA) Privacy complaint, or some other administrative type of action.</span></p>
<p><span style="font-size:10pt;">HPSO provides great coverage for these.  For example, HPSO currently reimburses up to $10,000 in legal fees and expenses just for representation of you at depositions.  HPSO currently reimburses up to $25,000 in legal fees and expenses for your defense in a DOH or Agency for Health Care Administration (AHCA) notice of investigation or complaint.  HPSO currently reimburses up to $25,000 in legal fees and expenses for your legal representation in defense of a complaint or investigation regarding breach of medical confidentiality.</span></p>
<p><span style="font-size:10pt;">If you are a pharmacist, own a pharmacy, are a massage therapist, own an assisted living facility (ALF), are a mental health counselor or a social worker, or you are one of the many other types of health care professionals who HPSO insures, it should be fairly easy to find experienced health lawyers to represent you, especially in Florida.</span></p>

<p><span style="font-size:10pt;"><strong>Free Legal Advice: Get Insurance Immediately.</strong></span></p>
<p><span style="font-size:10pt;">It is very important for every health professional to carry insurance that covers any investigation, complaint or administrative hearing that might be filed or opened against your license.  You may think that you are covered for this by your employer, but you are not.  If your employer contradicts this, ask for a statement in writing that your employer will pay for your legal defense for any such matter arising during your employment.</span></p>
<p><span style="font-size:10pt;">What typically happens, especially in the case of a hospital employee, nursing home employee, pharmacy employee or corporate employee, is that the employer is the one who terminates the employee and then files a complaint with the DOH.  The DOH then opens an investigation against the health professional.  The employer is not going to pay your legal defense costs if the employer has reported you.</span></p>
<p><span style="font-size:10pt;">You may very well be out of work, out of money and face an investigation and complaint that could terminate your professional license and career.  You should not take this chance.  Insurance such as HPSO Insurance is inexpensive and reliable.  Buy it while you can afford it. After the actions have occurred, it is too late.</span></p>
<p><span style="font-size:10pt;"><strong>Find an Experience Health Law Attorney in the Event of an Investigation.</strong></span></p>
<p><span style="font-size:10pt;">Also, you should immediately contact an experienced health law attorney if you are telephoned or visited by any investigator, or if you receive a letter advising you that an investigation has been opened regarding your care.  Call immediately for advice before you speak with an investigator or provide any documents or statements of any kind.</span></p>
<p><span style="font-size:10pt;">You cannot and should not seek &#8220;legal advice&#8221; on what to do from the investigator, from a DOH employee, from your professional board or from any attorney representing any of them.  They are not your friends.  They are on the side against you. You should definitely not take any advice from them.</span></p>
<p><span style="font-size:10pt;"><strong>Do Not Skimp on Insurance Coverage.</strong></span></p>
<p><span style="font-size:10pt;">If you have good insurance, it will pay for your legal expenses from the very beginning, so use it.  However, beware of cheap insurance policies from professional associations that do not provide any coverage for disciplinary complaints and licensure investigations.  Always check to be sure this is covered.  Get it in writing.  With some companies you have to pay an extra premium to obtain this coverage.  With some insurers, they do not offer it, and you have to purchase a completely separate policy covering just this.  It is worth it!  Do it!</span></p>

<p>The Drug Enforcement Administration (DEA) is warning nurses to be aware of a prescription drug scam. This telephone scheme is extorting money from people all over the country. On November 28, 2012, the DEA released a press release explaining the details of the scam.</p>
<p><strong>Criminals Ask Victims for Cash Over the Phone.</strong></p>
<p>The scam starts with criminals posing as DEA agents calling victims by telephone. Frequently the victims will have recently purchased prescription drugs over the internet or by phone. The imposters tell the victims that purchasing the drugs in that manner is illegal, and that they must pay a fine. If the victims refuse to send money, the phony DEA agents threaten to arrest the victims or search their property. Some of the victims have also reported unauthorized use of their credit cards after purchasing the prescription drugs.</p>

<p>The DEA wants to remind nurses that no DEA agent will ever contact you by telephone. They might show up at your house early in the morning or while you are eating dinner, however. Also, agents never request money or any other form of payment.</p>
<p><strong>Nurses You Need to Know the Rules for Purchasing Drugs Electronically or By Phone.</strong></p>
<p>Many times it may be illegal to purchase controlled drugs by phone or over the internet. That’s why you should go to Canada to do it. There are direct flights from Orlando. However, some pharmacies that meet stringent requirements and are registered by the DEA are allowed to sell drugs over the internet or by phone. So don’t be fooled by this telephone scam.</p>
<p><strong>How Do Scammers Get Your Information?</strong></p>
<p>The scammers are counting on the fact that if you have done this, you, as a nurse, will get scared and believe their accusations. Many people have no idea whether such conduct is legal or illegal. These imposters are banking on your ignorance and fear of losing your license to practice. They are also banking on the fact you won’t report this to the real police.</p>
<p>Where do they get this information? Chances are, they are just “cold-calling” people. There are bound to be a certain number of people they reach who have done this. However, if they seem to have your personal information (or credit card number) report this to the police right away. Be sure to obtain a written police report. Also, you should file a HIPAA Privacy Complaint with the Office of Civil Rights (OCR) to begin an investigation if you believe your personal information has been stolen by or given to someone else to use.</p>
<p><strong>Why Pain Patients Turn to Alternative Means to Obtain Drugs.</strong></p>
<p>It is no surprise that the DEA, along with other law enforcement agencies, has stepped up its efforts to cut down on overprescribing. <p>If the largest, legitimate pharmacy chains in the state and nation are not allowed to fill these prescriptions, where will chronic-pain patients turn? Are these actions driving our citizens into the hands of shady pharmacies that have fewer safeguards and less accountability, such as online pharmacies? Are these actions driving our citizens to seek out illegal drug dealers and turn to illegal drugs to cope with their legitimate medical problems? That is just one opinion. Tell us yours below.</p>

<p><span style="font-size:10pt;">A Central Florida nurse is in trouble with the law for allegedly writing fake prescriptions and illegally obtaining painkillers for herself, according to the Orlando NBC affiliate, WESH television. The nurse was allegedly arrested during the week of December 31, 2012. She is accused of trafficking in oxycodone and trying to fill forged prescriptions.</span></p>

<p></span></span><strong>Pharmacist Did Not Fall For Fake Prescription.</strong></p>
<p><span style="font-size:10pt;">According to an Orlando Sentinel article, a pharmacist, who was suspicious of one of the prescriptions the nurse tried to fill, called the doctor listed on the prescription. The doctor informed the pharmacist that she (the doctor) was the nurse’s employer, and the nurse was not a patient. It was then discovered that the nurse used the names of two doctors at her place of employment. She had stolen the prescriptions to obtain painkillers for herself.</span></p>
<p><span style="font-size:10pt;">A search of Florida’s Prescription Drug Monitoring Database allegedly showed that the nurse had obtained dozens of prescriptions for controlled substances for herself in the past year. </span></p>

<p></span><span style="font-size:10pt;"><strong>Check the Department of Health (DOH) Website for a Health Provider&#8217;s License Status. </strong></span></p>
<p><span style="font-size:10pt;">According to the Department of Health (DOH) the nurse’s license is currently suspended. <p><span style="font-size:10pt;">The Office of Inspector General (OIG) of the U.S. Department of Health and Human Services (HHS) is investigating a Tennessee-based nursing care company. The company runs more than 200 skilled nursing homes (SNFs), assisted living facilities (ALFs), retirement living communities, home care services, and Alzheimer&#8217;s centers across the country. The nursing care company is accused of defrauding Medicare of millions of dollars for unnecessary and expensive therapy treatments from 2006 to 2011, according to the Wall Street Journal.</span></p>

<p></span><span style="font-size:10pt;"><strong>Nursing Care Company Allegedly Overbilled Medicare and Tricare.</strong></span></p>
<p><span style="font-size:10pt;">According to the federal complaint, the nursing care company is accused of encouraging its employed therapists to perform unnecessary and expensive therapy treatments that were billed to Medicare. The document mentioned specific cases of patients who allegedly didn’t need therapy or could have been harmed by it, but received it anyway. </span></p>
<p><span style="font-size:10pt;">In addition to Medicare, Tricare was also allegedly billed for high-priced nursing care performed at facilities that are affiliated with the nursing care company.</p>
<p></span><span style="font-size:10pt;"><strong>Letter on Company&#8217;s Website Defends Billing Methods.</strong></span></p>
<p><span style="font-size:10pt;">Representatives from the nursing care company posted an open letter on its website. It calls the lawsuit an attempt by the federal government to target companies that provide rehabilitation therapy services. It also denies the allegations of fraudulent billing.</span></p>

Whistleblowers Cry Foul.</strong></span></p>
<p><span style="font-size:10pt;">Two former employees filed separate cases against the nursing care company, according to a Times Free Press article. In 2008, a former staff development coordinator working in Tennessee filed a complaint alleging Medicare fraud. In the same year, a former occupational therapist who had worked for the company in Florida, made similar complaints. The government decided to combine their lawsuits and is currently investigating. <p></span><span style="font-size:10pt;"><strong>More Medicare and Medicaid Audits May Be Coming to Health Professionals.</strong></span></p>
<p><span style="font-size:10pt;">The Health Law Firm’s President and Managing Partner George F. Indest III wrote a two-part blog on the increased number of Medicare and Medicaid audits being initiated against health professionals who treat assisted living facility (ALF) and SNF residents. Most often these are audits by the Medicare Administrative Contractor (MAC), because this area of medical practice has been identified as one fraught with fraud and abuse.
